Pleural Plaques Compensation Saga Continues

The Damages (Asbestos-related Conditions) (Scotland) Act, which received Royal assent last week, has now been contested by Aviva, AXA, RSA and Zurich. The four companies control over 50 percent share of the employers’ insurance market, and would have to face most of the claims arising due to the Act.

The controversial Act makes pleural plaques sufferers in Scotland eligible for compensation, which could result in claims worth millions of pounds for the insurers. It reverses a 2007 decision of the House of Lords that the existence of pleural plaques does not constitute a case for compensatable damage.

The insurers opposing the Act contend that it overlooks evidence that pleural plaques have no symptoms and do not result in severe conditions like mesothelioma. They argue that the Act is not in line with the legal principle that only physical injury suffered due to negligent exposure to risk calls for payment of compensation.

The insurers further argue that the Act does not weigh the financial effects on companies and taxpayers in Scotland. They fear a rise in claims from people exposed to such a risk, which would increase insurance costs for all firms and hurt the economy.

After this latest development, the pleural plaques issue has again come into the limelight. Several prominent personalities are arguing for the Scotland ruling to be applicable across the UK. However, with the review appeal, debate surrounding the issue will be reignited.

Get Your Email Signature File to Get You Clients

It’s always important to educate the people who know you about what you do. What I’ve noticed over the years of teaching people how to attract more clients is that they don’t use ALL the marketing real estate they have in a way that will get them clients. That might be the case with you too, but we’re going to change that today when we talk about using your e-mail signature as a Client Attraction tool.

Get your email recipients to take ACTION by enabling the “signature” feature in your e-mail program. This feature allows you to create a short message that goes out at the bottom of every e-mail you create or reply to. The message should be relatively short, but compelling enough to get them to take action.

It should contain the basics, like your name and the name of your company; however, I always recommend adding more. It can contain your tagline, Unique Selling Proposition or Competitive Advantage. It should contain your website address (if you have one). It does not have to contain your e-mail address since that will be in the header of your e-mail anyway, but it’s always safe to add it. Working Effectively With Safelists

Safelist Advertising At Its Optimum:

If you’ve been on the Internet for any time at all, you’re probably already familiar with the term “safe list”. It refers to any mailing list where the names and email addresses have been added with the viewer’s expressed permission.

There is a chance that individuals who joined a particular Safelist do not use the list for sending their own emails and his email address being overburdened with receving emails from the Safelist. When his email space becomes full, further emails will get bounced and returns to the Safelist itself (namely bounced emails), which is not a healthy condition for the safelist itself.

With safelists, you don’t generally have that problem…. People who join safelists most often use them on a regular and ongoing basis.

Also, messages sent through safelist systems usually carry a clear and concise opt-in clause. For example, “You are receiving this message because you are a member of Such-And-Such-Safelist” etc…

When it comes to choosing a safelist, the majority of viewers start with those that are free to join. And no need to say it is not the right way to way to go to.

Most of the members on a free safelist are more concerned about having their own ad viewed rather than viewing ads of other members of the list.

While in a paid safelist system membership are much more likely to be serious minded when it comes to Internet marketing. That means you would have a much better shot at paid members considering your offers than free members.

Also, free members only get to send out messages to other free members. That’s because safelist owners are well aware that the paid members are a more valuable asset. In order to send messages to those individuals, you’ll need to upgrade your own membership to paid status.

That same type of thinking also applies to quantity. It is more productive to send emails to 50 serious members than to 5000 ineffective members.

Size of a safelist does not matter at all. Also Joing to a list with more members implies you are going to receive more emails each day… and so will be the other members of the list.

Overall, it depends on the quality of the safelist members. Are they online marketers and business owners who take email marketing seriously? Or are the members of the list primarily freebie seekers who find it easier to simply slap an ad into an online form and click “send”?

In any way it is quite certain that majority of members won’t be reading your messages. Of course, even members of smaller safelists will pick and choose what messages they read and which ones get trashed.

Now. Assuming you’ve chosen wisely – that you belong to safelists with serious-minded members – your next concern should be the kind of messages you send.

With regard to the message itself, start with an intriguing subject line. Something like “Five Surefire Methods To Increase Traffic”. or, “Tips On Creating The Perfect Website”.

As you can see, these headings will encourage the viewer to read on, a process that should ultimately lead them to your website and/or sign-up form.

Last but not least, it’s important that you’re able to comfortably manage all of the safelists you join.

Start by organizing whatever valuable items you’ll be giving away (report, ecourse, ebook). Next, create several different and compelling messages.

Once you’ve got everything ready, make up a schedule for when and how those messages will be sent. If you take some extra time to plan the entire system ahead of time, all you’ll need to do is keep repeating that same process week after week.

In a nutshell, here’s a quick rundown of the entire safelist process:

1. Choose safelists for quality rather than member quantity

2. Create a subject line that invokes interest
3. Use “soft selling” instead of “hard selling”
4. Give the reader some incentives
5. Note down their name and email address for future contact

6. Send to each safelist on specific alternating days of week
7. Rotate different ads to each safelist on a weekly basis

Always remember… your purpose should never be to force ads on thousands of safelist members. Instead, try to develop solid relationships that will ultimately lead to ongoing sales.

2. I – Interest

Once you’ve got their attention, it’s time to get them interested in your message.

An easy way to do this is to simply highlight or ‘create a problem’ they may be experiencing. This puts them on alert and peaks their interest.

For instance, you could highlight the pains of how getting hundreds of spams daily could affect their business, and how there’re no good solutions in sight…

3. D – Desire

The ‘desire’ section of your message is where you introduce your proposed ’solution’ to the problem stated.

Fact is, people need solutions to problems. To be an ultra-successful e-mail marketer, your job is simply to give them what they want!

4. A – Action

Getting your rea.ders to take positive action, to act on your message, is probably the most important part of your entire campaign.

But a high response rate is only possible if you’ve created the flow of Attention, Interest and Desire successfully.

To encourage immediate action, you should tie a specific deadline or give ’scarcity’ to the solution you’re offering. For example, a 40% discount for the next 2 days only. Let them know that if they miss this dea.dline, the discount would end and they would have to pay a higher price for the same solution.

The necessity for better email management and email archiving grows everyday. Email (electronic mail) changes and evolves with technology. In order to understand the email management technology that will be best for you or for your business let’s take a step back and look at the origins of email itself.

Where Did Email Come From?

Believe it or not, email actually existed before the Internet did. The use of email began as early as 1965 when users of mainframe computers (huge computers that are used to store massive amount of data such as census reports, etc.) would share time on one computer because it was impossible to buy lots of little personal computers as there were none. These mainframe computer users would leave electronic messages on the computer for other users who would be using the same computer at another time. In a way, it was like simply leaving a note on an office desk for a co-worker, but the message was electronic and thus did represent an early form of electronic mail.

The ARPANET Contributes to Email and Email Management

The ARPANET computer network was the intellectual predecessor to the Internet. The ARPANET was also the first network that allowed data to be transferred in packets (referred to as packet switching). Transferring data in packets allowed more information and communication to go through one physical line instead of many lines which either carried communication from one node to another or were dormant as was often the case when circuit switching was the main method of data transport. The ARPANET greatly increased the popularity of using email as a means of communication. The ARPANET probably also led to folders and other email management tools, which were helpful in the organization and location of specific emails.

What About the @ Sign?

The development and the evolution of the ARPANET also led to new developments in electronic mail. Ray Tomlinson was one of the privileged few who had access to the ARPANET and was the first to use the @ sign to separate the name of the user from the name of his/her computer. Through the developments of the ARPANET and Ray Tomlinson’s contributions, email rapidly became more popular amongst computer literates. Email soon became the killer application of the ARPANET.

As more and more people began to be aware of the ARPANET, they began to be aware of the benefits of rapid electronic communication. Because of the demand, other protocols were developed for other groups with time-sharing computers. These protocols allowed many groups to send electronic messages to each other. Think Twice Before You Click the “Submit” Button

Moreno, a UC Berkeley undergraduate who was brought up in Coalinga had posted an essay which included some negative comments about her hometown. Well, Coalinga has never been known for its beautiful scenes, but for its prison, the mental health institution and a Ranch. The title of the essay was “An Ode to Coalinga” and it started with “The older I get, the more I realize how much I despise Coalinga.” During the time the essay was on Moreno’s MySpace, the principal of the Coalinga High School saw it and passed it on to the local newspaper called the Coalinga Record newspaper. It later published the essay under Moreno’s full name.

After several days of posting, the author apparently had second thoughts and took the essay down from her MySpace layouts. However, the negative effects to the residents of Coalinga were irreversible. Their feelings were hurt and they didn’t take it well. The family house has been shot several times and the members even received death threats. The family had to move to somewhere else and its business which has been operated smoothly for 20 years was forced to close down.

Poor Moreno did her best to strike back, some of her family members and she started a lawsuit against a numbers of defendants for public disclosure of private facts and intentional infliction of emotional distress. Publisher of the newspaper was able to get away under an anti-SLAPP motion while the principal and the school district were not that lucky. They will be the defendants in this case.

Moreno’s privacy invasion claim will stand no chance in the court. According to the judge, once she posted the essay on her MySpace site, no matter how big the expected audience is, it’s open to the general public at large. The claim that her last name was not used for the essay was also rejected by the court since her full contact detail can be easily attained from her MySpace page which also included a picture of her.

On the other hand, the intentional infliction of emotional distress is still under discussion by the jury. The important aspect they will be looking at is whether what the principal did was extreme and outrageous in its nature.

I guess after this unfortunate case, it wouldn’t hurt to repeat the cliché: Do not post anything online that has the potential to make to the front page of the newspaper. What’s even more important is, once the “submit” button is hit, there is no way you can undo it. It is nave to think that one can take it back simply by deleting the essay. Don’t put the stake too high if you can’t afford to lose.
